OEA/OFT – THE OMBURDSMAN FOR ESTATE AGENTS/OFFICE OF FAIR TRADING
ARLA and NAEA membership are discretionary and not compulsory. New applicants for association membership have applied of their own free will because they want to adopt a strict code of practice and also seen to be operating a more professional business than that of their competitors. If you instruct a solicitor the Law Society protects you. Most people will use an ABTA registered travel agent. If you instruct a surveyor then they will normally be either RICS or ISVA members and so on. The membership of Companies to these professional bodies, protect the public from malpractice and help to maintain confidence and obtain recourse from those members Firms.
ARLA is the only professional organisation to be solely concerned with the Lettings market. Members are required to demonstrate that they have a detailed grasp of the Lettings & Management sector. Member firms must hold Professional Indemnity Insurance. ARLA’s bonding scheme for clients rents and tenant’s deposits, provides the only such protection available in the Private rented sector.
Both ARLA & NAEA operate Bonding Schemes. This basically means that your money (if any) held by the member Agent is insured. The Bonding Scheme covers the misappropriation of any client funds and is in place to protect both Landlords and Tenants. Membership requires that we lodge our Professional Indemnity Insurance certificates (which must be for £250,000) with the Associations. Furthermore we are also required to provide Accountants certificates confirming that our client account balances.
OFT & OEA MEMBERSHIP
The Office of Fair Trading have launched a non compulsory membership scheme which is intended to recognise the Agents who operate to the highest standards and are prepared to put in the necessary time and effort to ensure the most professional service for their clients. Membership of the Ombudsman for Estate Agents (OEA) ensures that agents not only practice in an acceptable manner but also that there is an external and independent body to investigate should anything go wrong. Whilst this is still not the formal licensing scheme most professional agents would like to see it is at least a firm step in the right direction taken by the Government and most reputable agents will be members.
